			<content:encoded><![CDATA[<p style="text-align: justify;">New York Lemon Laws and the Federal Lemon Law (the Magnuson-Moss Warranty Act) compensation for consumers in New York of defective cars and trucks and other vehicles and products, including motorcycles, recreational vehicles, boats, computers, and other consumer appliances and products. To qualify under the Lemon Law New York or the Federal Lemon Law, generally must have a product that has undergone several repair attempts by the factory warranty by the manufacturer. The lemon Compensation Act may include restitution, replacement or cash compensation. The following comments briefly explain the New York Lemon Law and how it applies to you.</p>

<p style="text-align: center;"><strong>New York</strong><strong> Lemon Law</strong><strong><br />
<strong>What is the purpose of the new drive from New York Lemon Law?</strong></strong></p>
<p style="text-align: justify;">The New Car Lemon Law (General Business Law 198-A) provides a legal remedy for consumers who are buyers or lessees of new cars and some used cars (see next question), which turn out to be lemons. If the car does not conform to the terms of the written warranty and the manufacturer or its authorized dealer is unable to repair the car after a reasonable number of attempts during the first 18,000 miles or two years, whichever comes first, the consumer can choose a full refund or a comparable replacement car. A copy of the law can be found at the back of this brochure.</p>
<p><strong>The cars are covered by the Lemon Law?</strong></p>
<p>The law covers both new and used cars, including demos, which meet the following four conditions:</p>
<p>1. The car was under warranty from the manufacturer&#8217;s new vehicle at the time of original delivery, and</p>
<p>2. The car was purchased, leased or transferred within one of the first 18,000 miles or two years from the date of original delivery, and</p>
<p>3. The car either: (a) was purchased, leased or transferred in New York, or (b) is currently registered in New York and</p>
<p>4. The car is primarily used for personal purposes. Some examples of cars that are covered by the new car lemon law are:</p>
<p>• A new vehicle purchased or leased to a dealer registered in New Jersey and New York;</p>
<p>• one year of age, show cars with less than 18,000 Mill Product in a New York dealer and registered in New Jersey;</p>
<p>• a used car with less than 18,000 km and less than 2 years old, bought from a dealer registered in Connecticut and New York;</p>
<p>• a used car with less than 18,000 miles and less than 2 years old, received as a gift from a friend and registered in New York.</p>
<p><strong>What does the phrase &#8220;used primarily for personal purposes?</strong></p>
<p>A car is primarily used for personal purposes when its principal use is for personal, family or household. These purposes include, for example, using the car for household errands or to drive to work. A car may be used for both personal and commercial use, provided that personal use is predominant (over 50% of use).</p>
<p><strong>Motor homes are covered?</strong></p>
<p>Motor homes are also covered under the law, except as to defects in systems, fixtures, apparatus or other parts that are residential in nature. However, complaints from campers are subject to special reporting requirements.</p>
<p><strong>The motorcycles and off-road vehicles covered?</strong></p>
<p>Motorcycles and all terrain vehicles are not covered by law.</p>
<p><strong>Are all rental cars covered?</strong></p>
<p>The law covers only those leased cars where the lessee is responsible for car repairs.</p>
<p><strong>Cars are owned or leased by businesses covered?</strong></p>
<p>Yes, whenever the car is used primarily for personal, family or household.</p>
<p><strong>What is the manufacturer&#8217;s duty to repair?</strong></p>
<p>With respect to covered cars sold and registered in New York, the law imposes an obligation on the manufacturer for repair, free of charge and without any deduction, any defect covered by the warranty, if the consumer notifies the manufacturer or its authorized dealer of such defect within the first 18,000 miles of operation or two years from the date of original delivery, whichever comes first. Once timely notice of the defect is given, the manufacturer can not charge for the repairs, regardless of when repairs are made. Any consumer who has been charged for repairs or a deductible during this period should contact the Attorney General.</p>
<p><strong>What should consumers do if they find a problem with your car?</strong></p>
<p>The consumer should immediately report any defect or &#8220;condition&#8221; either directly to the manufacturer or its authorized dealer. A &#8220;condition&#8221; is a general problem as a difficulty in starting, repeated stagnation or a malfunction of the transmission, which can result from a defect in one or more parties. If the consumer reports the problem to the dealer, the law requires the dealer to forward written notice to the manufacturer within seven days. By law, notice to the dealer is considered notice to the manufacturer. Unless otherwise provided by his lawyer, consumers should follow to make their monthly payments if the car is financed or leased. Failure to do so may result in a recovery that may adversely affect the rights of a consumer of lemon.</p>
<p><strong>What should a consumer do if the dealer refuses to make repairs?</strong></p>

<p>It is presumed that there has been a reasonable number of attempts to repair a problem if, during the first 18,000 miles of operation or two years from the date of original delivery, whichever comes first, either: (1) the same problem has been subject to repair or four more times and the problem still exists, or (2) the vehicle is out of service by reason of repair of one or more problems for a cumulative total of more than 30 calendar days and the problem still exists.</p>
<p><strong>What special reporting requirements exist for Motor Home Owners?</strong></p>
<p>The law imposes special notice requirements for motor homes, which are designed to afford the motor home manufacturers one final chance to repair the defect before consumers can take advantage of the solutions offered by the lemon law. If the mobile home was the subject of three repair attempts or was out of service for repairs for 21 days, whichever comes first, the consumer shall notify such fact to the manufacturer or its authorized dealer by certified mail, return receipt requested, before for arbitration or initiate a lawsuit under the lemon law.</p>
<p><strong>The motor manufacturer should consumer’s prior written notification of these special requirements?</strong></p>

<p><strong>What constitutes a substantial impairment of value?</strong></p>
<p>This will depend on the facts of each case. In general, the consumer&#8217;s claim must be on a serious problem. For example, a defect in the engine that the car is clearly substantial unviable. Some courts have determined that the cumulative effect of numerous lesser defects can add up to substantial impairment of value.</p>
<p><strong>Are there exceptions to the manufacturer&#8217;s duty to refund or replace?</strong></p>
<p>The manufacturer has no obligation to provide a refund or a replacement vehicle if:<br />
(1) the problem does not substantially decrease the value of the car to the consumer, or<br />
(2) the problem is the result of abuse, neglect or unauthorized alteration of the vehicle.</p>
<p><strong>How can demonstrate that consumers have a lemon?</strong></p>
<p>The consumer should be able to document repeated repair attempts. Therefore, it is very important to keep a careful record of all complaints and copies of all work orders, repair bills and correspondence. A licensee is required by the Department of Motor Vehicles (DMV) rules to provide a legible and accurate written work for each time any repair work is carried out in the car, including warranty work. Consumers may contact the DMV in Albany at 518-474-8943 if you have a problem obtaining their repair orders.</p>
<p><strong>What should be included to reimburse the consumer?</strong></p>
<p>The refund must include the price of the car (cash plus taken into account), including all options, plus title and registration fees and any other governmental charges, less any deductions required by law.<br />

What are the &#8220;legal deductions?&#8221;</strong></p>
<p>The manufacturer may deduct a sum of kilometers above the first 12,000 miles. You can not make deductions for the first 12,000 miles of use. The law provides that the deduction is calculated on the mileage in excess of 12,000 miles times the purchase (or lease) price, divided by 100,000. For example, if a defective car has 15,000 miles on its odometer and a cost of $ 10,000, the deduction for use would be $ 300 (3,000 multiplied by 10. $ 000 divided by 100,000). Moreover, a reasonable deduction can be taken for any damage not due to normal wear.</p>
<p><strong>It is the different amount of refund if the purchase be financed?</strong></p>
<p>The refund by the manufacturer is the same whether the car was financed or not. However, when the vehicle is financed, instead of going full restitution to consumers, the refund must be divided between the consumer and the lender (bank or finance company). In general, the lender will calculate how much is still owed by the consumer and apply the refund to that amount. The balance of the refund then wills consumers.</p>
<p><strong>If the car was rented, what is the refund calculated?</strong></p>
<p>When renting a vehicle, the refund payable by the manufacturer is divided between the consumer / lessee and the leasing company (the company that the consumer makes lease payments) according to a formula set by law. The rental price to be refunded to the consumer / lessee is the total payment by the lessee (including emission trading) plus total monthly lease payments, minus interest charges and service fees. For example, suppose a consumer who leases a new car under a three-year contract, makes a down payment $ 1,500, and pays a monthly lease payment of $ 300. Monthly payment of $ 300, $ 75 is allocated as interest payments. After you make twelve monthly payments, the lessee is granted a refund under the Lemon Law. The refund will be $ 4,200 calculated as follows: Deposit . . . $ 1500 + Monthly Payment. $ 3600 (12&#215;300) $ 5,100 &#8211; less interest (12&#215;75) 900 total refund: $ 4,200 If the monthly payment includes other service charges such as insurance and other expenses paid on behalf of the lessee, such amounts will be deducted from the reimbursement of the tenant. Part of the leasing company for the refund is the balance of the price of &#8220;lease&#8221; as that term is defined in the Act.</p>

Rather, the consumer is entitled to receive a car of that year and model and has about the same mileage as the car being replaced.</p>
<p><strong>How can a consumer rights under the Lemon Law to be enforced?</strong></p>
<p>A consumer has the option of participating in an arbitration program or claim against the manufacturer directly in court. If a manufacturer has established an arbitration procedure which complies with federal regulations and lemon law in the state, the manufacturer can refuse to provide a refund until the first consumer participates in the procedure or the state arbitration program. Any action under the Lemon Law must be commenced within four years after the original delivery date.</p>
<p><strong>If the consumer wins in court, may also recover attorney fees?</strong></p>
<p>The law authorizes the court to award reasonable attorney fees to a successful consumer.</p>
<p><strong>What is arbitration?</strong></p>
<p>An arbitration procedure is much less complicated, slow and expensive to go to court. The arbitration hearing is informal and strict rules of evidence do not apply. The arbitrators rather than judges, listen to each side, review the evidence and make a decision.</p>
<p><strong>Arbitration what programs is available to consumers in New   York?</strong></p>
<p>Consumers can participate in the State of New York Lemon Law Arbitration Program (“Program of New York&#8221;), established by the lemon law. New York Program is administered by the New York State Dispute Resolution Association (“NYSDRA&#8221;) pursuant to rules issued by the Attorney General. (A copy of the regulations can be found in the back of this brochure.) Decisions under the New York Program are binding on both parties. Consumers can also choose to participate in arbitration programs established by automobile manufacturers. Decisions under manufacturer programs are not binding on consumers. Consequently, consumers who have gone through the program of the manufacturer and may still not be satisfied arbitration under the New York program. However, any decision of the arbitration technique may be considered in an arbitration hearing or subsequent court proceedings. The law permits manufacturers to require consumers to first participate in the program from the manufacturer, if it complies with federal regulations and lemon law in the state before filing suit in court for relief under the lemon law.</p>
<p><strong>How does a consumer participate in the Program of New   York?</strong><strong><br />
</strong><br />
A consumer must first complete a Request for Arbitration &#8220;, which can be obtained from any regional office of the Attorney General. (A list of regional offices of the Attorney General can be found at the end of this booklet). The completed form should be returned to the Attorney General&#8217;s New Car Lemon Law Arbitration Unit of the Attorney General, 120 Broadway, New  York, and New York 10271.</p>
<p><strong>How the New York Program Operate?</strong></p>
<p>The Attorney General will review how to determine if the consumer&#8217;s claim is eligible under the Lemon Law to be heard by an arbitrator. If accepted, the form will be sent to the administrator for processing. The Administrator will ask the consumer to pay the required filing fee. Upon receipt of the filing fee, the Administrator shall appoint an arbitrator and schedule a hearing to be held within 35 days. If rejected, the form will be returned to consumers along with an explanation for the rejection. A complete step description of New York Program follows this &#8220;question and answer&#8221; in this prospectus.</p>
<p><strong>Who are the arbitrators?</strong><strong><br />
</strong><br />
The arbitrators are volunteers who have been trained in the Lemon Law and arbitration proceedings by the Attorney General and the Administrator.</p>
<p><strong>It&#8217;s a consumer is entitled to a hearing?</strong></p>
<p>Consumers have an absolute right to an oral hearing. In an oral hearing, both the consumer and the manufacturer&#8217;s representative have the opportunity to present their case in person before an arbitrator.</p>
<p><strong>Can a consumer choose a hearing on documents only?</strong></p>
<p>A consumer may choose to have a hearing on documents only by indicating this preference on the &#8220;Request for Arbitration&#8221; form. In a &#8220;documents only&#8221; hearing, both parties must submit their written positions. If a consumer requests a &#8220;documents only&#8221; hearing, the manufacturer may object, in which case a hearing will be scheduled.</p>
<p><strong>Can a stenographic record or tape recording of the hearing be?</strong></p>
<p>Any party to the arbitration may require in your account, a verbatim record or a record of the hearing on its own, even if the other party objects. If a court reporter or recorder is used, upon reasonable notice, through the Administrator, he must give the other party.</p>
<p><strong>The consumer does not need an attorney to the arbitration hearing?</strong></p>
<p>New York Program is designed to be accessible to consumers without the need for a lawyer. However, both the consumer and the manufacturer can use a lawyer or anyone else to help them, if they so wish.</p>
<p><strong>How should consumers prepare for the hearing?</strong></p>
<p>Consumers should keep a copy of your &#8220;Request for Arbitration&#8221; form to use as a guide in preparing for the hearing. The form contains all the necessary information at the hearing. Consumers also recommends:</p>
<p>(a) Meeting Documents. Bring to the hearing records of everything concerning the purchase and the problem, including a copy of the purchase contract (invoice), all correspondence, work orders, and warranty.</p>
<p>(b) Organize the records. Keep records in chronological order. This will serve as a guide in presenting the history of the problem.</p>
<p>(c) Prepare an outline. This will help present and remember relevant information.</p>
<p>(d) Prepare Questions to the manufacturer&#8217;s representative. This will ensure that omits certainly important.</p>
<p>(e) Arrange for witnesses. The presence of witnesses, especially auto mechanics, or their sworn statements may be useful for documenting the problem.</p>
<p><strong>What if consumers do not have all the documents?</strong></p>
<p>Upon payment of the filing fee and before the hearing, consumers may make a written request to the arbitrator, through the Administrator, to direct the manufacturer to provide all necessary documents or other information. Consumers also can ask the umpire to cite the documents or witnesses to appear at the hearing. A sample letter requesting documents can be found in this booklet.</p>
<p><strong>How should consumers to present their case at the hearing?</strong></p>
<p>At the hearing, consumers should present their case in a clear, organized and concise. Consumers are recommended:</p>
<p>(a) State the specific nature of the problem.</p>
<p>(b) Status of discussions with representatives of the distributor or manufacturer.</p>
<p>(c) Describe and document each repair attempt.</p>
<p>(d) Describe and report any developments that may have occurred since the &#8220;Request for Arbitration&#8221; form was filed.</p>
<p>(e) Provide proof of each point, especially those the manufacturer may dispute.</p>
<p>(f) Present any witness that may provide relevant information.</p>
<p>(g) State of the requested relief.</p>
<p>(h) At the end of the presentation, a brief summary of the facts discussed.</p>
<p>What Happens If a party fails to appear at the hearing?<strong><br />
</strong><br />
Unless the hearing has been properly rescheduled, if the manufacturer or the consumer fails to appear at a hearing, the arbitrator nonetheless conducted the hearing and issue a decision based on the evidence and documents in the file.</p>
<p><strong>When can a consumer expect a decision?</strong></p>
<p>A consumer can expect a decision, generally within 10 days of the hearing. Sometimes, however, the referee calls for additional documents or information be submitted, in which case the decision may be delayed.</p>
<p><strong>A consumer may recover the filing fee?</strong></p>
<p>If the consumer is successful, the arbitrator&#8217;s decision for consumers must include the return of the filing fee.</p>
<p><strong>When should a decision maker delivering an arbitrator?</strong></p>
<p>Within thirty days. In most cases, the manufacturer&#8217;s representative shall contact the consumer within this period to arrange return of the vehicle in exchange for a refund or replacement vehicle. Failure of the manufacturer to perform in this time period allows consumers to recover an additional $ 25 for each working day of noncompliance, up to $ 500. If the manufacturer does not voluntarily pay any applicable penalty, the consumer can sue to recover this penalty in Small Claims Court. However, this deadline and penalties are not applicable when replacing a consumer requests a car built to order or with options that are not comparable with the car.</p>
<p><strong>How is the return of the Implementation of cars?</strong></p>
<p>The common procedure is that all parties concerned &#8211; the consumer, the manufacturer&#8217;s representative, and if the vehicle is financed or leased, the lender or the representative of the leasing company &#8211; gather at a designated time and location to execute the documents necessary to change the car for a refund or replacement. The consumer may choose to return the car to the dealer or the dealer who sold or tried to repair the car. No additional shipping charges may be imposed on consumers for the return of the car.</p>
<p><strong>What if the manufacturer fails to comply with arbitration award?</strong></p>
<p>If the manufacturer does not comply with the award, the consumer can enforce the arbitrator&#8217;s decision through the courts by bringing an action to confirm the award. This action must be commenced within one year from the decision. Consumers should consult a private attorney if you wish to use that resource. If the consumer is successful, the Court will become the award to a court decision and may award attorney fees. The court may also award reasonable attorney fees incurred to enforce the collection of the prize.</p>
<p><strong>Under what circumstances can modify an arbitration award?</strong></p>
<p>The reasons for the change are very limited. In general, the awards may be amended only to correct a miscalculation or a technical error in the award. For example, a modification can be requested when the mileage deduction was miscalculated or the filing fee was omitted from the refund.</p>
<p><strong>When should an amendment application be made?</strong></p>
<p>Either party may request modification by the arbitrator of the award by written request to the Administrator within 20 days of receiving the prize. The other party will have the opportunity to oppose the amendment. The arbitrator must rule on all requests within 30 days after receipt of the request. To modify an award after 20 days, an application to court may be necessary.</p>

I decided to buy a car, because I thought it is a necessary tool in my work and business, and then I hope I can earn enough money to buy a house and lot. </span></p>
<p style="text-align: justify;"><span style="color: #000000;"> In connection with cars, someone who previously consulted me about the lemon law because the new car he bought was allegedly defective. Unfortunately there is no lemon law in the Philippines. Given that the registered buyer of that car is a corporation, the applicable provisions of the Consumer Act can not be invoked by a &#8220;consumer&#8221; refers to natural persons, i.e. you and me, and excludes persons legal and corporations.</span><span id="more-2887"></span></p>
<p style="text-align: justify;"><span style="color: #000000;">Anyway, there was an attempt, through Senate Bill No. 2464, enacting a Filipina &#8220;Lemon Law&#8221;. The bill seeks to provide protection to purchasers of motor vehicles that prove to be defective. The Senate bill seeks, as it is now dead, to promote the full protection of consumer rights in the sale of motor vehicles off the sales and marketing practices that are misleading, unfair or anti-consumer and public interest. </span></p>
<p style="text-align: justify;"><span style="color: #000000;"> A motor vehicle is considered a lemon if it is unable, unreliable or unsafe for ordinary use. Under the lemon law, a car is a lemon if during the lemon law rights of the car: 1) has been subject to repair three or more times, but the same non-conformity persist, 2) the lack of compliance is serious safety defect and has been subject to repair one or more times, or 3) is unavailable due to repair for a cumulative total of 30 calendar days. The law provides that manufacturers or distributors who meet the standards of their vehicles. If a car was found to be defective or a lemon, the buyer could get a full refund or a replacement. </span></p>
<p style="text-align: justify;"><span style="color: #000000;"> Lemon Law Rights period establishes the period within which a consumer can report any violation or breach of a warranty and a defect or disorder that significantly affects the use, market value or safety of a motor vehicle. If the nonconformity is not repaired or corrected within that period, a consumer has the right to: (1) replacement, or (2) back with refund of full purchase price.</span></p>

			<content:encoded><![CDATA[<p style="text-align: justify;">The Missouri New Vehicles Warranty Law, commonly called the &#8220;Missouri Lemon Law&#8221; protects buyers of new vehicles through the application of the express warranty from the manufacturer. The Missouri Lemon Law does not apply to use cars.</p>
<p style="text-align: justify;">All new vehicles sold or leased with warranty provisions are covered under the Lemon Law, except for commercial road vehicles, mo-peds, motorcycles and the chassis is not recreational vehicles. Also included are demonstrators or lease purchase of vehicles, provided that a manufacturer&#8217;s warranty was issued as a condition of sale.</p>
<p style="text-align: justify;">New-vehicle owners must report problems or defects in writing to the manufacturer to use the provisions of the Lemon Law. The manufacturer must allow a &#8220;reasonable&#8221; number of attempts to correct the problem.<span id="more-2884"></span></p>
<p style="text-align: justify;">Under the Missouri Lemon Law, it is presumed that the manufacturer has given a &#8220;reasonable&#8221; number of attempts to correct the problem if:</p>
<p style="text-align: justify;">The vehicle has been in the repair shop for the same problem four or more times and the problem still exists, or The vehicle has been out of service due to a problem covered under warranty for 30 days from delivery, excluding delays that are beyond the control of the manufacturer. If the problem can be fixed in a reasonable number of repair attempts, the manufacturer may offer a cash refund or a vehicle of comparable value. Under the Missouri lemon law, manufacturers can deduct a &#8220;reasonable compensation for the use of vehicle consumers&#8221; of restitution. The Missouri lemon law also provides that the replacement vehicle must be acceptable to the consumer.</p>

<p style="text-align: justify;">I. TYPES OF CLAIMS</p>
<p style="text-align: justify;"><strong>A. Lemon Law &amp; Boats</strong><strong> </strong></p>

<p style="text-align: justify;"><strong>C. Express Warranty </strong></p>
<p style="text-align: justify;">The manufacturer or dealer may offer a warranty and suggest that while the repairs were undertaken at no cost, no claim can be made. The North Carolina law is similar to lemon laws in other states, although there are some notable differences too.</span></p>
<p style="text-align: justify;"><span style="color: #000000;">As with other lemon law requires that automobile manufacturers repurchase or replace a vehicle that has not been adequately repaired within a &#8220;reasonable number of attempts. In North   Carolina, this reasonable number of attempts is four or if the car has been out of service awaiting repair for a cumulative total of 20 or more days during a period of 12 months warranty.<span id="more-2271"></span></span></p>
<p style="text-align: justify;"><span style="color: #000000;">The North Carolina law lemon gives relief to those who buy or lease a vehicle having a gross weight of 10,000 pounds or less. The North Carolina Law Lemon covers cars, trucks, motorcycles and vans more. It does not cover, however, house trailers. The North Carolina Law Lemon covers any defects that impair the value, use or safety of the vehicle to the consumer. The defects have not affected the drivability of the car but could have problems such as defective paint, heating system or excessive noise.</span></p>
